In his role as committee chair, to make numerous changes to state laws concerning pesticide and fertilizer products sold in Kansas, such as their labeling, special registration, permitted uses, effectiveness claims, and other regulatory matters, while also proposing to cancel the scheduled 2010 reduction of related penalties and fees enforced by the Kansas Department of Agriculture.   Official Text and Analysis.

Recommending the bill be passed as amended. House committee amended the bill to clarify: that the registration fee for an agricultural chemical would not exceed $150 per year; and, that if a commercial applicator fails to employ one or more commercial applicators certified in each subcategory in which pesticide applications are made, then the agency would suspend the pesticide business license for that use until the business employs a properly certified applicator.

Recommending the bill be passed as previously amended by House committee.

To provide a daily late fee for certain registration penalties and to reduce several pesticide-related fees beginning in 2015.

To adopt the conference committee report; to enact the Senate-passed version of the bill regulating fertilizers and pesticides, but with the following changes: insert changes proposed in HB 2295 concerning dairy product labeling; and, insert the SB 316 proposal to transfer the review of nutrient utilization plans requirements for swine facility operators from the Kansas Department of Agriculture to the Kansas Department of Health and Environment.

To not adopt the conference committee report, but to appoint a new conference committee for further negotiations.

Approving Rep. Powell's original motion to adopt the conference committee report; to enact the Senate-passed version of the bill regulating fertilizers and pesticides, but with the following changes: insert changes proposed in HB 2295 concerning dairy product labeling; and, insert the SB 316 proposal to transfer the review of nutrient utilization plans requirements for swine facility operators from the Kansas Department of Agriculture to the Kansas Department of Health and Environment. House approval thereby forwards this compromise version directly to the governor for her consideration.
